By downloading, accessing, or using any mobile application developed and published by Hamza Oucha ("I", "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, do not use our apps.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Hamza Oucha. By using our apps, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. License to Use

2.1 Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use our apps on your personal device(s) solely for your personal, non-commercial use, in accordance with these Terms and applicable laws.

2.2 Restrictions

You agree NOT to:

• Copy, modify, or create derivative versions of our apps
• Reverse engineer, decompile, or attempt to extract the source code
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Distribute, sell, lease, rent, or sublicense the apps to any third party
• Use the apps for any illegal, harmful, or unauthorized purpose
• Attempt to circumvent any security features or access restrictions

3. App Availability and Updates

3.1 Platform Availability

Our apps are currently available on iOS devices through the Apple App Store. We may extend availability to other platforms at our discretion.

3.2 Updates and Modifications

We reserve the right to modify, update, suspend, or discontinue any app or feature at any time without prior notice. You may be required to download updates to continue using the app. System requirements may change, and you are responsible for ensuring your device meets these requirements.

3.3 No Guarantee of Uninterrupted Service

While we strive to provide reliable service, we do not guarantee that our apps will be available at all times or operate without errors, delays, or interruptions.

4. Subscriptions and In-App Purchases

4.1 Payment Processing

Some of our apps offer premium features through in-app purchases and subscriptions. All payments are processed by Apple through the App Store using your Apple Account. We do not have access to your payment information.

Third-Party Payment Processing: We use RevenueCat, a third-party service, to manage subscription validation and analytics. RevenueCat processes anonymous purchase data to verify your subscription status. For more information, see RevenueCat's Privacy Policy at https://www.revenuecat.com/privacy

4.2 Subscription Terms

Auto-Renewal: Subscriptions automatically renew at the end of each billing period (weekly, monthly, annually, etc.) unless you cancel at least 24 hours before the current period ends.

Billing: Payment will be charged to your Apple Account at confirmation of purchase. Your account will be charged for renewal within 24 hours before the end of the current period.

Pricing: Subscription prices vary by region and are displayed in your local currency in the App Store. Prices are subject to change with advance notice.

Free Trials: Some subscriptions may offer a free trial period. If you do not cancel before the trial ends, your Apple Account will be automatically charged for the subscription price.

4.3 Managing Subscriptions

You can view, manage, and cancel your subscriptions at any time through your Apple Account settings:

1. Open the Settings app on your iOS device
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select the subscription you want to manage
5. Tap "Cancel Subscription" if desired

4.4 Refunds and Cancellation

No Refunds: Except as required by law, all purchases are final. We do not provide refunds for unused portions of subscription periods. Cancellation takes effect at the end of the current billing cycle.

Requesting Refunds from Apple: If you believe you are entitled to a refund, you may request one directly from Apple. Visit https://reportaproblem.apple.com or contact Apple Support.

4.5 Price Changes

We may change subscription prices from time to time. You will be notified of any price increases in advance, and your continued use of the subscription after the price change constitutes acceptance of the new price.

4.6 Access to Premium Features

Some apps offer free features alongside premium subscription features. Free features may be modified or removed at any time. Premium features are only accessible with an active subscription and will work across all devices signed in to your Apple Account where the app is installed.

5. Third-Party Services

5.1 Paywall Technology

We use Superwall, a third-party paywall service, to present subscription offers and pricing information within our apps. Superwall helps us optimize the user experience for subscription presentations. Superwall may collect anonymous usage data. 5.2 App Store Terms

Your use of our apps is also subject to Apple's App Store Terms and Conditions and Licensed Application End User License Agreement (EULA). In the event of any conflict between these Terms and Apple's terms, Apple's terms shall prevail to the extent required by Apple.

6. User Conduct

You agree to use our apps in compliance with all applicable laws and regulations. You will not:

• Use the apps for any unlawful or fraudulent purpose
• Interfere with or disrupt the operation of the apps
• Attempt to gain unauthorized access to any systems or networks
• Use automated tools (bots, scripts, etc.) to interact with the apps
• Violate the intellectual property rights of Hamza Oucha or any third party
• Transmit viruses, malware, or other harmful code

7. Intellectual Property Rights

7.1 Ownership

All content, features, functionality, software code, designs, graphics, text, and other materials in our apps are owned by Hamza Oucha and are protected by international copyright, trademark, and other intellectual property laws.

7.2 Trademarks

Our app names, logos, and product names are trademarks of Hamza Oucha. You may not use these trademarks without our prior written permission.

8. Privacy and Data Security

Your privacy is important to us. Our collection, use, and protection of your personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

Data Security: While we implement reasonable security measures to protect your data, you are responsible for maintaining the security of your device and Apple Account credentials. Notify us immediately if you suspect unauthorized access to your account.

9. Disclaimers and Warranties

9.1 "As-Is" Basis

OUR APPS ARE PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Guarantee

We do not warrant that:

• Our apps will meet your specific requirements
• The apps will be uninterrupted, secure, or error-free
• Any defects or errors will be corrected
• The apps will be compatible with all devices or operating systems

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HAMZA OUCHA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OUR APPS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Hamza Oucha, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of our apps
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws or regulations

12. Termination

12.1 By You

You may stop using our apps at any time by deleting them from your device and canceling any active subscriptions.

12.2 By Us

We reserve the right to suspend or terminate your access to our apps at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Requests by law enforcement or government agencies
• Discontinuation of the app

12.3 Effect of Termination

Upon termination, your right to use the app will immediately cease. You will remain liable for any obligations incurred before termination. Termination does not entitle you to a refund.

13. Children's Privacy

Some of our apps are rated for all ages (4+) and are safe for children. We do not knowingly collect personal information from children under 13 without parental consent. If you believe a child has provided us with personal information, please contact us immediately.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or app features. When we make significant changes, we will:

• Update the "Last Updated" date at the top of this page
• Notify you through the app, via the App Store, or by email (if applicable)
• Post the updated Terms on our website

Your continued use of the app after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Morocco, without regard to its conflict of law principles.

15.2 Dispute Resolution

Any disputes arising out of or related to these Terms or your use of our apps shall be resolved through good-faith negotiations. If negotiations fail, disputes shall be subject to the exclusive jurisdiction of the courts in Morocco.

15.3 Exceptions

Nothing in this section limits your rights under consumer protection laws in your jurisdiction or prevents you from bringing claims in small claims court if permitted.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hamza Oucha regarding your use of our apps.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

16.4 Assignment

You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. We may assign these Terms at any time without restriction.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, or internet service failures.

18. Apple-Specific Terms

For apps distributed through the Apple App Store, the following additional terms apply:

18.1 Acknowledgment

You acknowledge that these Terms are between you and Hamza Oucha only, not with Apple Inc. ("Apple"), and Apple is not responsible for the app or its content.

18.2 Scope of License

Your license to use the app is limited to a non-transferable license to use the app on any Apple-branded device that you own or control as permitted by the Usage Rules in Apple's App Store Terms of Service.

18.3 Maintenance and Support

Hamza Oucha is solely responsible for providing maintenance and support services for the app. Apple has no obligation to provide maintenance or support.

18.4 Warranty

To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app. Any claims, losses, liabilities, damages, costs, or expenses related to warranty failures shall be our sole responsibility.

18.5 Product Claims

We, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product liability claims, consumer protection claims, and intellectual property infringement claims.

18.6 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

By using our apps, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
